By accessing or using this Website, you agree to be bound by these Terms.

All artwork displayed on this Website is original, human-created content and is not generated by artificial intelligence systems. While certain technical tools may be used for image optimization, scaling, or file preparation, such processes do not involve the creation or generation of artistic content and do not alter the originality or ownership of the artwork.

6. Artwork Ownership and Licensing

All artwork offered through ArtZentury Cleared Art remains the intellectual property of Arberday Film and Television Productions, Inc. or the individual artist, unless otherwise stated. Purchasing a physical original or print grants you ownership of that specific item for personal display purposes only. You do not acquire copyright, reproduction, or commercial rights. Licensing artwork for media, film, or television use requires a separate written agreement. Licensing transactions are conducted off-site and governed by individual contracts.

Project-Specific Use. Licensed artwork is approved for specific project use only, as defined at the time of licensing. Use of artwork in additional episodes, seasons, spin-offs, re-edits, or unrelated projects requires a separate license or written approval.

Perpetuity Limitations. Where artwork is licensed in perpetuity, such perpetuity applies only to the specific approved use and does not extend to new uses, additional episodes, seasons, or projects.

Any reproductions, prints, enlargements, or physical outputs created from licensed digital artwork files remain the property of Arberday Film and Television Productions, Inc. and/or the original artist. Such reproductions are provided solely for use within the scope of the applicable licensing agreement and do not transfer ownership, copyright, or derivative rights to the Licensee.

Unless otherwise agreed in writing, all reproductions must be returned to the Licensor at the Licensee’s expense upon completion of the licensed production use. Licensees are responsible for maintaining such reproductions in reasonable condition consistent with normal production use. Reproductions that are lost, materially damaged, permanently altered, or not returned within a reasonable time after completion of use may be subject to replacement, repair, or holding fees as defined in the applicable licensing agreement.

7. Artwork Licensing for Media Production

This Website’s primary function is to serve as a professional showcase and portfolio of artwork available for licensing in film, television, broadcast, streaming, advertising, and other media productions. All licensing transactions are conducted off-site and require a formal written agreement with Arberday Film and Television Productions, Inc. (“Licensor”). No license, permission, or right to use, reproduce, modify, or publicly display any artwork is granted—explicitly or implicitly—through browsing, downloading, or viewing artwork on this Website.

To inquire about licensing artwork for your production, please contact us through the Website’s official contact form or email info@artzentury.com with details about your project, intended media, and duration of use. All license terms, including fees, crediting, exclusivity, and delivery formats, will be governed solely by the executed licensing contract. In case of any conflict between that individual licensing contract and these Terms of Service, the licensing contract will control.

Note: Use of any artwork from this Website in film, television, streaming, or any commercial media without an executed licensing agreement constitutes unauthorized use and infringement of intellectual property rights.

Restrictions on Use and Retention. Licensed artwork may not be used for artificial intelligence training, machine learning datasets, generative systems, or the creation of digital derivatives beyond the scope expressly permitted in the executed licensing agreement.

Technical Preperation. Technical preparation of artwork for approved production use, including file optimization, resolution scaling, color correction, formatting, or print-readiness adjustments, does not constitute artificial intelligence training, dataset creation, authorship, co-authorship, or derivative creation by any third-party software or service.

Physical reproductions created from licensed digital files may not be retained for future productions, reused, resold, gifted, archived, or transferred without the Licensor’s prior written consent. All reproductions remain subject to return and condition requirements as set forth in the licensing agreement and these Terms of Service.

8. Payments and Transactions

Payments for physical artwork and prints made through our online store are securely processed by third-party providers such as Squarespace and Apple Pay. We do not collect or store your full payment information. Prices are subject to change without notice. Sales of original art and prints are final unless otherwise stated. For off-site licensing agreements, payment terms are defined individually and are not processed through this Website.

9. Shipping Policy for Physical Artwork

We apply a standard shipping rate for all physical artwork orders delivered to addresses within the 48 contiguous United States. We reserve the right to apply surcharges for oversized items or expedited shipping requests, which will be communicated prior to finalizing the sale. For all shipments to Alaska, Hawaii, or international destinations, please contact us at info@artzentury.com for a custom shipping quote before purchasing. The buyer is solely responsible for all international duties, taxes, and customs fees associated with the shipment.

10. International Use

Our Website is operated from the United States and governed by U.S. and Florida law. If you access the Website from outside the United States, you are responsible for compliance with your local laws. All agreements, communications, and transactions are deemed to take place in Florida, USA.

Our Website may contain links to websites operated by third parties. These links are provided for your convenience only.
